Questions and Answers on Removal of Marijuana Possession Conviction

Now that marijuana is legal, thanks to the passage of Proposition 207, the Pima County Attorney’s Office can expunge (clean) people’s records for FREE. This is an important step into the future, as recreational and medical marijuana use has become normalized and legalized in Arizona. Before Proposition 207 was passed, many people were arrested and charged, went to jail, and experienced the collateral consequences of having a marijuana conviction on their record. For this reason, the Pima County Prosecutor’s Office is now working to clear the records of those who have marijuana convictions so that it can finally bring justice to those who have been adversely affected.

Who qualifies for expungement?

If at the time of your arrest you had used or were in possession of no more than 2.5 ounces of marijuana, 12.5 grams of marijuana concentrate, or 6 marijuana plants, you may be eligible for expungement. It is important to know whether your case was tried through the Pima County Superior Court or the Pima County Justice Court. This will determine if we can help you clear your record.

Where can I go to expunge my record?

Visit pcao.pima.gov/prop207. There you can fill out an online form that is available in Spanish and English and takes about a minute to complete. The form will not ask about your immigration status. If you are concerned about your own criminal legal situation, consult an attorney.

Why is this important?

This is an important opportunity for people who have been adversely affected by marijuana laws to finally be able to free themselves from the burden of having a felony conviction. Often times, these convictions affect job opportunities, educational opportunities, and the ability to find housing. This is an opportunity to make a clean slate.
